^ That's pretty sweet! :)

Heck, post-up what you've got - "run whatcha brung!" ;) It's not like I carried any of that stuff on an everyday basis!

The vast majority of what I carry are either fully production and as common as you can get, or just a little pimped/tarted-up. The remainder consist of knives that are now valuable (older Spydercos and Benchmades) but were at the time all too common. :)

^ You can have your cake in Ohio - you just can't eat it. I'm actually right there with you.

Ohio's even more convoluted than that, though: a difference can be made between a "cutting tool" and a "weapon."

There's also no State preemption of knife laws, so each municipality can set up what it deems right by itself. There's some commonality to the prohibitions - i.e. "switchblades," push-knives/daggers, etc. - but there's also some ridiculousness such as a 2.5-inch "blade length," the interpretation itself being open to enforcement discretion.

As I mentioned back in the flashlight thread, there's the recent case of Michael Porschein (http://legacygt.com/forums/showpost.php?p=4684662&postcount=337) for those who want to enjoy a bit of good reading, but there's others, too, The Ohio 10th District Court of Appeals summarizes the existing Ohio case law in State v. Cattledge, 2010-Ohio-4953, and fellow OFCC member BobK abstracted it for those of us (like me) who's a bit dumb on the law side of things:

If you want a detailed discussion of the Ohio case law in different appellate districts, see State v. Cattledge, 2010-Ohio-4953.

Thanks for that link, I enjoyed the case law review.

Summarizing from the ruling, it appears that knife factors used in deciding whether a knife is "designed or specially adapted for use as a weapon" include (but not limited to):

  • Not be easily opened with one hand, folding knife with a locking, four-inch blade: NOT a deadly weapon. (State v. Anderson (1981), 2 Ohio App.3d 71)
  • Easily opened with one hand, folding knife with a locking, three-inch blade: IS a deadly weapon. (In re Gochneaur, 11th Dist. No. 2007-A-0089, 2008-Ohio-3987)
  • A knife with a serrated edge may be considered when deciding if a deadly weapon. (In re Gochneaur, 11th Dist. No. 2007-A-0089, 2008-Ohio-3987)
  • Two-handed opening, non-locking blade, serrated 4 inch blade, blade tip not sharp: NOT a deadly weapon (State v. Flowers (May 1, 1985), 1st Dist. No. C-840564)
  • Two-handed opening, locking blade, 4 inch blade: NOT a deadly weapon (State v. Sears (Feb. 27, 1980), 1st Dist. No. C-790156)
  • Easily opened with one hand, knife concealed in a cylinder, 2 inch blade: IS a deadly weapon. (State v. Manning (Feb. 16, 2001), 2d Dist. No. 18347)
  • Easily opened with one hand using a hole in the blade, 4 1/2 inch blade: IS a deadly weapon. (State v. Graham (Oct. 23, 1998), 6th Dist. No. S-97-050)
  • A "butterfly" knife required two handed opening, defendant was a tool & die worker who presented evidence of all the ways he used a knife as a tool at work: NOT a deadly weapon. (State v. Wheeler (Mar. 19, 1999), 2d Dist. No. 17197)
  • Two-handed opening, 3 1/2 inch blade: NOT a deadly weapon, plus 2 inch folding razor: NOT a deadly weapon (Mayfield Heights v. Greenhoff (Nov. 14, 1985), 8th Dist. No. 49741)
  • Two-handed opening, non-locking blade, 2 1/2 inch blade: NOT a deadly weapon (State v. Ratcliff (Oct. 26, 1983), 4th Dist. No. 82 CA 13)
  • Easily opened with one hand using a small knob on the blade, locking blade, serrated edge, sharp tip : IS a deadly weapon. (State v. Cattledge, 2010-Ohio-4953)

Reviewing them all, the money quote seems to be:

The ability to open the knife with one hand by either using the knob or flicking the wrist also takes the knife out of the realm of an "ordinary" pocket knife. Therefore, given these characteristics, the knife in question was a deadly weapon, as it was designed to be used as a weapon. . . . .It is sufficient for our analysis that the knife blade can be brought to bear with one hand, using whatever method to do so.
My favorite pocket knife has one of those knobs on the blade and I can snap it open one-handed easily. I don't think I'd risk carrying it in Ohio.

Whereupon in the same thread another OFCC member made the following remark, and I replied:

As usual, I will worry about things that need worrying over. I'll continue to carry my knives as tools and my gun as a defensive weapon. Been carrying a knife for 40 years..will continue to.

^ I don't think anyone is really saying that's worth getting our underwear knotted about - rather, it's just that given what's been seen in today's world, the cavalier attitude of "rather be tried by 12" doesn't paint the full picture. I know that both of us expressed concerns with Zimmerman's "training" came up for question during the trial this summer, and who in this community can forget what Michael Porschein had to go through? Yes, he won the war, but those battles were fought precisely on the grounds of a legal gun being at his side, but the legalities of his knife being played. He won the war, but what happened to him that night at the roadside? What troubles and hassles did he have to bear in his everyday life because of the incident?

While my own experiences - like yours - speak their own real-world tales of the variable and subjective nature in which knife-laws enforcement has taken here in NE-Ohio (heck, yes, I'm a Suspect  , and my old friends as well as various custom makers can tell you what kind of ridiculous folders I loved to carry :p ), I still make it clear to anyone asking about "Ohio's knife laws" that they're really treading on thin ice.

That all said, I really never carried my autos as a defensive tool. I can honestly bring any of my Waved or ghetto-Waved knives into the fight a lot faster, and with a lot more certainty than I can in relying on the magic of an auto - of which even the most expensive and truly custom-made I've had, on-occasion, not fully lock-up upon deployment or simply fail to deploy at all. From unscripted force-on-force, I know how hard it is to bring even a concealed fixed-blade into the fight...that level of difficulty ratchets up an order of magnitude when I have to deploy a concealed folder, and it gets magnified even more if I need to find a release button or, heaven forbid, trip a safety catch first. Certainly, there are those in the community who can actuate their autos (even with the safety) faster than I can even bring a fixed blade into the equation, and some are just as fast with the auto as they are Wave-ing, but I'm not one of them,, so I stick my ass with what works for me. :)

And that said, yes, there are definitely scenarios for which an auto is very, very useful.

Oh, and that's right. For my daughter's first knife, I gave her the little Microtech MiniUDT Tactical that a buddy of mine gave me as a sweetener in a trade.

It's so much fun watching a little girl of 5 pressing a little button to release a little tiny blade. Hit Girl, eat your heart out.

I EDC this:

Gerber 06 http://www.gerbergear.com/Military/Knives/06-Auto-Knife_30-000377

http://i.imgur.com/GghsCpd.jpg

I've owned many, many knives in my day and I prefer this one to any other. It's got a bit of weight to it, but I like that. It fits my hand perfectly and holds an edge decently.

It is however illegal in my state :( IDGAF though.

Was at a gunshow this weekend looking for ammo/ supplies. Thought it was time for a new CRKT knife as I like them and I lost my last one during a bachelor party. There was an entire table setup with CRKT knives only. I chose this one and in my experience their blades hold and edge well.

All of my CRKTs have held up well over the years... until I lose them that is. Lost one at a 4th of July party and another during a bachelor party, party bus etc. This is my third. I keep my knives that I use often sharp and the CRKTs need less sharpening than many others I have. This one is gold because of the titanium nitirde coating.

After I saw a 5% off sign and remembered I had my gift card with me, I knew it was time to give it a new home.

Today's selection...

Zebralight H600w MKII and a Benchmade 5500 Mini Presidio Auto. This is about the bulkiest combo I carry. Most of the time it's a nice AA light and a Kershaw Chive.

I also keep a Leatherman Charge TTi on my belt in it's holster with a Maratac AAA Cu & a Cu Peanut lighter.
