If you have a tune that accounts for the lack of cats and blocks the rear 02 sensor from thowing a code, then you will pass an obdII scan and therefore an emissions test. Even if you have a high flow cat, which was my point, you will probably fail. By your remarks I'm guessing they don't do a sniffer test in NY like they do in NJ. Also, if they do a visual inspection you will fail. You can avoid this by putting a heat shield on your downpipe. ^thats cause you have no engine management like an accessport.
