Accident Voids Warranty??

I mean give the guy a break he is venting I had $14,000 worth of front end damage I know where he is coming from and what is that smell that the 5eat make when your really betting on it I mean driving fast on the hiway any way it makes me want to barf I

mean have any other 5eat do that

 

ps. my accident happen at 4,000 miles@know I have 19,000

You cant lose ur warranty after an accident; it is not legal. BUT, if you have someone else other than a suby dealership fix your car, you will lose your warranty. So you should have had your exterior repairs done somewhere else, and the suspension fixed by subaru.

 

The fans on my lgt were on at all times for a period, i found out that it was a defect, so i got it replaced by subaru (waited 2weeks), then my engine was 25% blew(cylinder #4), cuz the new ecu has a new problem which cause the engine to studder; and over boost; so subaru checked everything out, replaced my ecu again, then replaced my uppipe+downpipe(cloggings); air flow meter; all the pistons, rings.. engine shit..etc(took 3 weeks this time) and so now im basically still re-breaking-in my not-so-new lgt... should i file lemon on this??? my car is bone stock.. why did all these happen.. im already thinking of trading this car in for a camry or something reliable.. :(

I believe lemons are same problems 3x times in a row but I think you need to check CA lemon laws.

 

Probably was those empty beer cans.

 

I got this off a CA lemon law specialist website.

"The "lemon law" presumption states that if you have 1. purchased or leased a new car, truck, motorcycle, or motorhome, for 2. personal or small business use, and 3. if during the first 18 months or 18,000 miles you brought the vehicle to a dealer for repair of the same or similar problem four or more times, or only two or more times if the manufacturing defect results in a condition that is likely to cause death or serious bodily injury, or if it was out of service for a total of more than 30 days within that time, and 4. if the problem is still not fixed, then 5. the legal presumption is established."

Heres a little history on my car. I've been thru 5 wheels already due to potholes and found out the hard way that a warranty doesnt cover wheels and tires. So I've spent too much on that. I hit a curb in a blizzard in january.

I was wondering about that. I was going to suggest that maybe you had a rim that was out of round. Rotating the wheels front to back is a pretty easy diagnostic test.

 

Why do you have to keep the car for three years? Why don't you just sell it instead of letting it depreciate all tha time and be so bitter, frustrated and unhappy?

I drive in the same areas you do and yes the roads suck. You need to know the areas you're driving in if you are going to drive rough.

 

There are a few roads I know to slow down because the roads are terrible, other roads are just as clean as any other city.

 

I'd still pick the LGT in NJ after owning it for a year. If I wanted a perfect ride I would have bought a MB but then I'd be spending 2x as much for the same power.

 

 

One thing, I had a 2006 OB as a dealership loaner and it was pretty fun aiming for the potholes instead of avoiding them :)

Its a lease and selling now would hit me real hard with the depreciation already so...I gotta keep it. I cant believe this car depreciated almost 10K in roughly 9 months. They sure dont tell you that when youre signing the contract.

update on my car.. everything is fixed and working okay.. still feel a lil studdering now and then.. hmmm how to say this.. its really hot in south california the past 2 weeks AND MY AC IS NOT WORKING!.. checked with dealer.. and turns out.. there is a freaking LEAK! all the FREON GAS has leaked out. = _ = sooo hoooottt~~~~ will the problems ever stop?~!!!

i dont know but.. subaru fixed it today and refilled freon gas... so.. car was good today.. UNTIL TONIGHT!! F*ing s*t mother of s*t!!!!!!!!!!! CHECK ENGINE LIGHT CAME ON!!! and of course.. subaru special, flashing crusing light >< ..AHHHH!!! im sooo tired of this damn car

update on my situation: it was the bearing that needed to be replaced...but was only grinding when going to the left...i dunno...any updates on the thread starter?

Rubix - I see that you are certainly under a hill of bad luck with this car. But, as many have suggested, it's not Subaru's fault, technically, as the car is pretty decent. Potholes aren't "covered" by anyone, anywhere... neither are curbs and such. No automaker would cover these items, period, as they are not "defects" which is what a warranty is all about.

 

We have pretty bad roads here in MA, too. A friend of mine has a Focus SVT and has been through a few rims as well (same tire and wheel size as our cars), and he's a pretty attentive driver, but sometimes you just get the wrong pothole that one time, and that's it. I don't know what to tell you (or him) but I know I have not had any problems (and have made it through this winter) with no wheel/pothole issues. Maybe I'm just lucky, or maybe I seem to notice them more, and slow down more when necessary. I don't know.

 

As for the flashing cruise light - had that one with the loose gas cap, too... right after doing a UP install on a full tank... pretty weird, and annoying... but easy enough to fix - lowering the front of the car, removing the cap, and putting it back on resolved that issue quickly.

 

In regards to your accident... any further repairs are certainly not warranty related, so you can't expect them to cover it "under warranty" but that certainly doesn't mean you are SOL. You simply have to go after the right people - in this case, the insurance companies and the place that performed the work to repair your car. It is their responsibility (legally and ethically) to repair your vehicle properly - period. Any damage that was "missed along the way" of the original estimate is also their problem, not yours, not Subaru's. I recall a front end accident on my previous car (my wife's fault, not mine!) where the distributor cap and AC were inoperable after the repair. The AC was not properly repaired, and although the condesor was replaced, the hoses were now bad. Granted, they were probably "worn" orignially, but the way I presented it was simple: It worked fine before the accident, and now it doesn't. By playing a little dumb, it kinda helps, as it's really not your problem, nor your place to troubleshoot for them. They ended up bringing it in a few times before they found the problem, but it was all on them, and they did their job (with a little prodding). The disty cap was located near the front, and had to have been hit by the radiator during the accident, and was simply cracked through. Sure, I could have paid for it myself and be done with it, but this is what insurance is for... and I already paid my deductible, so let them foot the bill, damnit. A little more prodding and they put up on this.

 

I will admit, I did fail on one other count - the windows were grossly out of adjustment. I was trying to get them to cover this, but they said it could have happend due to a pothole or something. My mistake was that I didn't "go into" the "negotiations" of this repair well armed, and so I failed. I should have said, "well, if a pothole could bring the window out, then an accident like that SURELY must also bring it WAY out of whack, right?" I didn't so I never got that fixed, and did it myself.

 

As someone implied, having a good shop do the work is very important. Not to say that your shop is bad, but the choice you start with is important, since you have to go back to them for future repairs. In a new vehicle, I always try to go to the dealer, only because that way the whole "finger pointing" you are seeing now between warranties and repairs is eliminated... bottom line, it's their problem, and you don't care which department handles it... as long as it's done.

 

Again, in your case, you go back to the right place (the repair shop) and hash it out with them. Your ally in this mission is your insurance company especially if the accident is someone else's fault, as they want to see your car back to perfect shape, because that's their job (as your insurance company) and their best interest to preserve the value of the car.

 

Sorry for the long story, but I wanted to point out that it's NOT easy to deal with accidents - EVER. And it's all a matter of your logical insistance on your side, and keeping calm and collected with them. Sure, you can vent to us... we're not involved, and it is very frustrating... but just do your homework, and you shouldn't have to pay for any further repairs.
