Time to lawyer up and do some investigating into the safety records of the trucking company. This looks similar to that dump truck accident in Texas a few weeks ago and I believe that came down to ill maintained equipment as the cause after repeated violations were issued by state safety inspectors. This is why companies have insurance, might as well get something out of it, especially if you were thinking you were going to die.

Ya I have looked into the company a little and have found numerous lawsuits against them about equipment failures, some that resulted in wrongful death suits. The driver never even asked if we were ok or approached us. When I got the car hooked up to tow I was leaving and he driver said sorry man,and I said I'm just happy to be alive. I asked about the age and maintenance of the truck and he said sometimes the brakes don't work with another family from Vancouver bc standing there like I was supposed to be amused his company doesn't take risk management serious. Then his co-worker chimes in and adds that ya these things don't stop on a dime...he pushed my car 150 feet after hitting me at 60..they both were idiots. And for all who are interested, the company is called Ralph's concrete pumping llc,based of of south Seattle . Zurich insurance. Havnt dealt with them yet. All I know is I'm sore as ****,my shoulder has a AC seperation,my right ankle is sublux and my neck/spine have never felt like this. My friend was vomiting all day yesterday so I'm assuming we both have a concussion. I was able to salvage my ski box and two bike racks and roof rack,not hat I'll be skiing or biking anytime soon. I honestly think I'm going to go look at a car or suv higher off the ground than the legacy:(

I don't know how it is up there, but in AZ the braking systems in commercial vehicles must be inspected on a weekly basis. This means making sure that the brakes on every wheel work. Definitely get the maintenance logs, and if they refuse to give them just mention that you'll be getting them via discovery if you have to sue.

This is really awful :( Hopefully the accident doesn't leave you with permanent aches. I typically hear rear-ended accidents leave some back issues, although not serious ones but you might end up feeling it every once in awhile. I had my car rear-ended at a stoplight but not at that speed (maybe 20-30mph) Luckily the rusted up rear end cushioned the blow. Thank God I was okay. Good luck with the insurance companies.
