nm
If you are being politely asked then you can politely decline if you wish. If you have nothing to hide then it may be in your interests to satisfy his curiosity and show you're a law-abiding citizen. You increase you chances of a warning any time you treat the officer with respect. If you have non-CARB legal mods it isn't going to be in your best interests, ever. "I'm sorry officer I need to be on my way, can I leave?" But if the officer *demands* to conduct a search then what are you going to do? Answer: Don't argue at the roadside. Have your lawyer argue what is or is not Probable Cause at some later point. At the side of the road the cop will always win, even if if takes three of his buddies and enough taser shots to cause rolling blackouts in the surrounding area. Protest, loudly. Don't physically restrain them. CHP basically won't do this though.
ehsnils
thay can make you pop your hood and check for stuff? Must be the emissions thing out there. That is insane. "Stuff" can of course be illegal items/substances too. I wouldn't worry too much if there are mods that aren't obvious since the engine compartments are so different from ordinary cars that unless the cop really is a car specialist he/she wouldn't be able to tell if it's a stock or a mod. If there aren't a BOV and a lot of stuff that contains brands like K&N, Perrin etc. they will just have a hard time meditating over if that's correct for that model year or not. Just popping the hood and let them take a look will probably earn you cooperation points. It may even be their way to test how cooperative you are. Of course they may do an illegal search, but it's better to not be obnoxious about it because if the same cops sees you doing some minor misdemeanor another time they may remember you as not being a problem and take it easy. And also note that they may have confused you with someone else with a bad record. As a side note - my uncle had some problems traveling during the 70's since he did look like some terrorist. That terrorist is now dead so the problem is resolved. Better to be a bit annoyed than shot or behind bars.

That already is a law, its just like if the persons tailights don't work its their fault in the accident.
ehsnils
^ Depends on the circumstances, it's not a free ticket for you if they do have faulty tail lights.
HarryN
California is fun to visit, but not to live in. 3 of my relatives already moved back after only a year in LaJolla, Sacramento, and Los Angeles. Maryland is not any better, but for the first time, I saw someone kiss the Maryland ground. It was one of my relatives. I wish this was a story, but this is very true. BruceBruce
and I think there should a new law where if you rear end someone with tinted tail, you will NOT be held responsible.... Honestly if you cant see a car in front of you. well you shouldn't even be driving. Its not like im on a motorcycle or anything tiny here. Its a big ass car, and at night they are still lit up. Besides aren't license plates reflective anyway?

Consenting to a search doesn't really get you any points, it just fucks you over. PD tries to make it seem like it will, but it won't.
BennnGeee
don't tint tails or windows and you're good to go... The real trick is donate money to CHP every month and put that little sticker they give you on your window and your set
ClimberDHexMods
Add me to the list of people born and raised in Cali and f*****g hate it and will never live there again. Law enforcement cannot search your vehicle without your consent unless they have a tangible justification (such as a smell or a sound or a site of something suspicious). Cops are very good at asking this question in a way where you consent. They are the experts and you are most likely the noob at it. It's all on tape for both of your protection. There are great ACLU videos on youtube that explain your rights at a traffic stop thoroughly. You really can benefit from knowing what to do ahead of time. If you wish to waive your right to an illegal search, that is between you and the cop. define
don't tint tails or windows and you're good to go... Exactly! Modifying any of the "safety" equipment (like BRAKE lights) is just opening you up to the whole charade. The idea is to not have a reason to be pulled over to begin with. All the cops I've dealt with in my days have been very cool about the cars. If they mention mods, it's because they are curious most of the time. Just be friendly and don't bitch or whine even if he gets his ticket pad out. I love hearing Civics with 10 inch fart cans revving down the street at 150dB. These kids wonder why they get pulled over so often and "harassed" by cops. Subtle always wins.
