Ok some background information on the car it is a 2006 Legacy gt 5eat the car is stock except for a cobb ots 93 octane tune. The transmission has started to go (im assuming) because of the flashing sport light and also it is slam shifting and slipping.

That being said, ive been looking for a tranny that could hold some power and came across a used IPT built tranny on here but it is for a 2008 not a 2006. My question would be could I make it work ? and how ?

The pinouts and TCU are completely different. IF you want to do a lot of wiring it should in theory at least drive. It might be slightly angry about the shift coordination signals for the ECU missing on CANBUS. You could fix that by also swapping the ECU, but then you'd have to figure out a wiring conversion for that as well and deal with the immobilizer. So now you're swapping the gauge cluster and BIU, along with other wiring.

TL;DR: In theory yes. In practice it'd be cheaper to buy an 08-09 legacy, swap the tranny, and move on.
