Just got my car off the trailer and found this. http://img.tapatalk.com/a6937b21-db3d-4e44.jpg As you can see on the tire, something probably rectangular and metal hit the side. These wheels are fairly new with no markings up until today. The driver says he didn't do it. Ok.... Then tells me even tho he didn't do it, he will be more than glad to pay for it. Friend of a friend thing. He tells me to take it to a specific shop and they will fix it for around $60. Should I fight for a brand new wheel? All other 3 are damn near new, and all in perfect condition. New one from discount tire shipped is $140.00 What do you guys think? I will be pretty much demanding a new wheel since im not gonna deal with a sub par repair + sub par paint match. Just read through the Boston wheel repair thread not too long ago and I'm not going to let this turn into that. One of the spokes has rub marks on it too now... Whatever. I'll update you guys. Like I said, he didn't admit to it but said "you shouldn't have to pay a dime out of your pocket. I will pay for it." The hard part is convincing him to buy a new wheel rather than repair for 95. joeblow Posted August 19, 2012 Share Posted August 19, 2012 Yeah, in a civil suit you have to prove to a judge (or potentially a jury) that it was the driver's fault "by a preponderance of the evidence," AKA more likely than not. Unless you have timestamped pictures without damage right before it was loaded and then those pictures afterward with damage, you don't have enough of a suit to make it worth your while. People need to stop jumping straight to that conclusion. Sure it seems likely that the driver and transportation caused the damage, but you have no evidence outside of your word versus his. His offering to pay may be an indicator that he shows remorse which can be used to indicate guilt, but I don't know if there is precedent to support that. Sorry I don't have any cases to cite, but I'm sure they are out there. In the end though, it will cost more to retain a lawyer and waste time in a lawsuit than it would be to pay $140 for a new wheel, so don't waste your time. Talk to the guy and ask him if instead of paying for the repair he gives you that same amount toward a new wheel. If all else fails, offer to buy the wheel and then take reimbursement, because I know I wouldn't just give someone $50 for something that they may or may not get fixed.
