Copyright infringement...

This topic might have already been discussed somewhere else here but I just had to vent.

I wanted to have some of my Photo work printed as Posters for Family and Friends as Stocking stuffers so I went to Zazzle.com and uploaded the Photos and placed my order.

The next Day I got an e-mail from Zazzle, I copied and pasted it below, as well as the Photo in question:

I've e-mailed them back stating that the Photos are mine but I haven't heard back from them.

I guess what they're trying to say is that because the Photograph contains a Subaru, I'm violating the creative copyright of the Subaru name.

If that's the case then I guess anyone who's ever taken a Photo of their Car and printed it could be sued my the manufacturer because they didn't give express permission to take the Photo...

This new world order of political correctness and copyright infringement crap is more than I can stand.

You'd think companies like Subaru, Ford, GM etc, would love the free publicity and advertising that lovers of their product give when taking Photos of their Cars and publishing them.

I guess I'll have to get a large format Printer and do it myself... :evil:

Due to our sue happy society, this is the result. Kinko's gave my wife a line of crap when she tried to copy photo's of her dead parents for a funeral collage. The copyright doesn't belong to the person in the photo or to the person who paid for the original photo's, but rather to the photographer who took the photo's although they're just as dead as my wifes parents.

At least from the language they used, its seems to be a photo specifically that they are saying violates the copyright.

I expect it's not a problem (for Zazzle or any other interpretation of copyright law) to have an Outback "incidentally" in a picture, but in this case the collage is clearly focused on the car, to the point that it could be something created by Subaru's marketing department. (It's actually a nice piece of work, although the front-end picture looks too much like a fish-eye lens for my taste.)

 

Apparently Zazzle (and maybe Subaru) think that Subaru should have exclusive rights to create imagery of this nature. HPH

however.. I have never heard of them before now.. so I dont know that it means anything at all. :lol:

 

Either way.. this makes me mad... if you take the pic or the pic is of you, I say its yours, law of the land be damned in that regard.

 

the whole "intellectual property" crap is WAY out of hand and needs a severe injection of reality.

 

if its your pictures, your pshop work to make the collage and its your car.. they have no case. if you have some spare money laying around you should sue them for emotional damages in the $700 billion range. Its the magic number these days.

just remove the subaru logo and the name subaru.

 

i remember this incident at another car forum (mustangs i believe?) where the company also removed all the pictures they were using for a car of the month calender. even going as far as removing pictures of another manufacturer car saying that it was a copyright violation of Ford but for some reason left the pictures of one car that was clearly a mustang but was fully debadged and had no Ford markings left on the car.

So far after contacting Subaru I'm finding this is an issue with Zazzle because SOA replied and said that not only they don't have a problem with me printing my Photos, but they really liked them as well.

I think what's going on is companies like Zazzle are having a Knee jerk reaction after being harassed by other companies lawyers.

 

As for the Ford Mustang club blow up, it had to do with them, Cafe Express and a corporate lawyer working for Ford.

When Ford found out they contacted the club and Cafe Express and appologized, saying it was a big misunderstanding and that the lawyer went way beyond his athority.

 

It's just our upside down society were living in...

I work in Staples as an Easy Tech associate. Once in a while, I'll stroll down to the copy center to see if they need help or not... and not once have I, or the other associates bugged someone about "copyright infringement." Im 18, and I could careless what people make copies of. Look for the younger kids. Why? Because they don't care =)

I work in Staples as an Easy Tech associate. Im 18, and I could careless what people make copies of. Look for the younger kids. Why? Because they don't care =)

 

and this is whats is wrong... as a photog, if someone was using my work for their gain or publication without my consent, then i would be pissed. but i guess you "younger" kids don't understand that, while most of my pics i give to people have print releases, some don't as i don't expect them to be used. Whats funny for me is that i get question for copyright at costco when i am printing proofs for people ...i tell them i am the photog but hey dont believe me.

 

to the OP, as everyone else stated, they are your pics, you took them you own the rights, may choose another printer?

 

to the person who was mad at kinko's for deny to copy a photo, unfortunately that's exactly what copyright is for, it is also valid for 70years after the artists death, unless renewed by someone(IIRC)

exactly. that's someone else's work and time they put into, even if you think it's a just a photo. if it were so easy to take good photo's everyone would do it and we'd see incredible photography. but that's not the case. maybe if these younger gen folks didn't get paid their hourly wage for working (which is basically what they're doing), they'd have a better understanding that a copyright protects the artist/creator from people stealing their work. Most of us like to get paid for our work and time, at Kinkos, Staples, or otherwise...

 

to the OP, my guess, the reason Zazzle is questioning your print is because your label states what car and make it is. If you had put your name on there or something, I doubt it would have been flagged.

Yes it was with the Black Mustang Club(I owned a black Mustang Cobra and browsed the site alot) and Ford came down on cafepress and it got a little ugly. Ford claimed those pictures were theres or something because it had their trademark the "Mustang" in it. Well when many owners got pissed and wrote Ford about it. Some even told FoMoCo to come pay the monthly car payment on the Mustang they now own:lol: After a lot of letters, Ford investigated it, and the BMC president had her lawyers look into it as well. Of course they recanted their original views and allowed the BMC to make their calendar.

Yes and look at Ford now.

They've been so out of touch with consumers and so greedy they're at the brink of bankruptcy and are now asking us to bail them out...

Actually if you read, you would see they don't need any money. Ford can last through 2009, they have just asked for credit in case they need it. GM and Chrysler are the ones that need it with GM the worst as they won't make it to 2009.

Lol, I apologize if it went the wrong way, but I sell computers and electronics. I don't really work in copy center, but when I do, I don't ask people about the whole copyright things. Why? When you find either porno pictures or a picture of a customer's son who died in Iraq sitting inside of a printer, its uncomfortable to ask them. Plus, I only "help" when I can with very little things. I wouldn't be aware of the technicalities involving copyright infringements. Sorry brotha.
