[NEED HELP] Towing company damaged my car

If you are suing name the property owner in the same suit as well, that will get them involved. They have an insurance company too for liabilities like this. One insurance will fight against the other but are smart enough to settle out of court. Go for broke. Don't take a "deductable" reduction in your claim. Take the car to your choice of body shop for an appraisal. Since you have evidence of damage (photos), and they towed your car which is a likely event to cause damage, and they can present no real proof that your car was damaged prior to pick-up... umhh that's one for you. Also, file a police report for the damage to your vehicle, and a get a sticker or whatever is required by local law. This also proves you didn't declare damage prior to the towing, but you did declare damage after it - like a good citizen would do. More for your case.

 

If you are being honest to us, do all ground work and you'll win. Be persistent. The comings and goings of the towing company staff is no business of yours. Put time limits on responses and spell out the consequences.. e.g. if you have to leave a message on a phone, "you have one week to respond to me with .... (whatever you need)... or I will be serving your company paper to appear in court, thank you and have a nice day". Take notes of everything and every time you contact any party, keep a log. If when you do sue, you can start to add damage costs to cover your expenses and trouble of trying to resolve the matter in a civil way. Keep a mileage log where you drive for appraisals, etc.. all those miles are gas money.

I'd also be worried that they towed without flatbed and could be damage to AWD system and drivetrain

I second that! There's no way they could have got you out of that spot on a flatbed. Check your car manual about towing. Most tow companies know that towing a AWD Subaru means flatbed required.

Your word, and your photos, and your actions - like reporting the damage to police.

Youre in seattle? I know a good lawyer, but i have only used him for speeding tickets (And he has gottten me out of a ticket, my sister, my sisters boyfriend, my manager all got them taken off our record and then my mom had a 1200 ticket and it was reduced and changed to a non moving violation and he ended up paying for it)...

 

I am not sure if he does this sort of thing or he is just stricly traffic violations

 

But you should look into it... From my experiance i highly reccomend him.

All cameras embed EXIF data, although it can be altered with software so it's not a guarantee. With Windows XP, you can read the existing EXIF data from a JPEG photo by right-clicking on it, going to Properties, going to the Summary tab, then clicking on Advanced.

you can make a claim on your insurance and then they will go after the towing company. trust me the insurance companies have many lawyers.

 

i had to do this once and my insurance company went after the other guys insurance, only pita was that i didnt get my deductable refunded for like 2 months...

Good luck with this all. I would simply subrogate it with your insurance company if you have a low deductible.

Do the condo rules require the vehicle of an overnight guest to display a guest or visitor pass? If so, that explains why it got towed. If not then it shouldn't have been hauled away. Either way it doesn't explain the damages (is there any side they didn't f*ck up?)

 

If you've got the time, patience and persistence to pursue it on your own then go after the towing company and the condo association, especially if there was no legitimate reason for it to be towed, however the total damages may exceed the local small claims court limits. If it was towed for no reason I'd file a police report.

 

I'd dump it on your insurance company to deal with it. The contract towing company has a responsibility to take reasonable measures to protect your vehicle from damage while in their possession. At most you would only be liable for your comprehensive coverage deductible and towing fees if it was determined that you indeed were actually subject to being towed. You could still go after the towing company in small claims to recoup your deductible because of the gross disregard in preventing damage to your property while in their hands.

I parked away from the cement pole so I could measure the paint on the cement from the ground.

 

looks like paint on the pole is 8" or so taller than where my rear right side door handle is

 

I'll post more pics and draw my hypothesis on how they towed my car out tomorrow or so

 

Maybe when they lifted the rear of the car it was 8" higher.

Your insurance company should cover anything you've added to the car as long as it's mounted in a factory manner. If they've got to buy a bumper cover, they don't really care which one it is.

Were you parked facing in then? I'm confused cause you said they used dolleys for the rear wheels but the damage is on the drivers side which would mean they used dolleys for the front wheels. :iam:

 

I know this sucks buddy but don't give up. Clearly they nailed your car somehow. We all still want to know whether there are signs before you drive in that say "Condo owner parking only" or anything like that. They may have put a sign up in that one spot by you need to look around and see if there are signs anywhere else stating that the whole area is condo owner parking only. If not, then they indeed did tow your car illegally.

This is good advice. Call your insurance company right away and explain the circumstances. Also explain it's supposed to be flatbed towed.
