I was the one that said if you are going to court, you need to take a lawyer (or professional liars) end of story. I have been to court with and without lawyers, and the outcome has always been better with one. If someone does not like lawyers, that is their problem. It's very possible that the ABS didnt kick in at all because there's nothing that the tires to grab on to.. so regardless if the ABS working properly or not, if the tires have nothing to grip, they really have nothing to grip, wheel rolling or not. This is exactly what I was thinking. From the map, it looks like a very sharp right turn. If you were turning you wheel hard right, the ABS would have done nothing if the front wheels were skidding. I had a similar incedient several years back with my Outback. I was at a stop at the end of an exit ramp and it was snowing pretty good. I was screwing around (not saying you were) in the snow that day and pushed it a little too far. I was trying to make the back end break loose (fish tail), but as I went across the road, I caught some traction and headed straight for the curb and guard rail. First reaction is to hit the brakes, but since I had the wheel cut hard left, I did nothing but plow straight ahead. Luckly, I realize what was happening and straightened the wheel before I hit the curb or I would have had some suspension damage. I hit the curb, hopped it and just kissed the right front bumper to the guard rail. All I needed was an alignment. I was lucky. Link to comment Share on other sites More sharing options...

You may be screwed there, if you pulled them off, even if you didnt, your insurance company can claim you did. Thus Brake Failure ... Just out of curiousity, what insurance company do you have? It is a plastic sleeve with the airbag sensor wires inside. Sometimes it is yellow sometimes orange. It is so rescue crews know not to cut through it and set the airbags off. Someone asked earlier if you were cited...if so: (inhale) This is a single vehicle crash and it would be a civil infraction hearing. No need for a $1500 law student in a cheap suit. You can appear by yourself. It sounds like the State has no witnesses to cross examine you with. Other than the officer and he wrote merely what you told him because you were not at the original crash scene when he arrived. If you must go to court, present your case based on the conditions at the time of the wreck, meaning (hopefully) your crash was not a hazard to other motorists or bystanders. Take pictures, draw diagrams, whatever you think will help illustrate this fact. Most civil proceeding judges will either greatly reduce the fine or relieve you from it altogether if you present yourself competently and support your argument....but you will probably still be found responsible for the traffic infraction minus a fine. If driving school is offered as means of amends rather than fight the ticket, take it. Then your insurance company doesn't get the surprise when they run your 3 year driving abstract down the road. If you try snazzy lawyer crap like mechanical failure you'll piss the court off for wasting time on the docket. Just my dos cientos (.02) (exhale) I tell myself that an N/A Forester is just an STI without all the fluff like, power, handling, style, racing heritage, and curb appeal. Sucks that this happened but legally what argument does he have? I cant see any?? Is he trying to say its someone and/ or something eles's fault and not his?
