OCDetails Posted February 4, 2006 Share Posted February 4, 2006 Australian Police have been unable to recommend a prosecution for the following scam: A company takes out a newspaper advertisement claiming to be able to supply imported hard core pornographic videos. As their prices seem reasonable, people place orders and make payments via check. After several weeks, the company writes back explaining that under the present law they are unable to supply the materials and do not wish to be prosecuted. So they return their customers' money in the form of a company check. However, due to the name of the company, few people will present these checks to their banks. In fact, you could do the same thing to any company if you know who is in charge of accepting payments. It is easier to do on a local level to smaller businesses. This is why I don't extend credit and I don't take checks. A check is the most common form of contract that we sign and enter into every day. Do you mean if I have a $1000 balance and send a check for $100 and write "settled in full" they automatically reduce my balance to $0? What about the other $900? Jesse it varies by state. like if you cash a check that some wrote paid in full and you cash it because at least its something you are screwed in certain states. nj is not one of them though. in ny i think it counts as a contract. OCDetails Posted February 10, 2006 Author Share Posted February 10, 2006 Trust me... I was a paralegal for a very large consumer defense firm and this kind of stuff happens all the time. In fact, they teach it in contract law classes in law school. If you owe $1000 and you write a check for $100 and put in the memo field "settled in full" then the other $900 simply goes away. They can't collect on it and they can't bitch about it. All they can do is hope for some coupons for some lubrication in case someone does it to them again. HOWEVER, it will be reported on your credit as a Settlement which is just as bad as a write off or collection. It is still a 9 on a scale of 1 to 9 in badness. All it saves you from is collection agencies and lawsuits. Your credit score will still be thrashed. This isn't as effective on large corporations as it is on small businesses. In a large business you would have to send your check somewhere other than where you normally put your payments in. This isn't a class on screwing credit card companies, so I'll let you do the research on that one. However, if you wanted to try it to clear your tab at the local bar then it would be very easy to pull off. A check is a contract in every state. As long as the terms of your contract are clear then you can get away with it very easily.
