2013 Legacy Intermittent Non-starting problem & remote starter issue

I just took delivery of my brand new 2013 Legacy sedan, (Canadian convenience package model). I had the dealer install the Subaru remote start accessory prior to delivery. The salesman used it to start the car when I took delivery and everything worked fine. That night I started the car several times with the key in -28 deg. C weather with no problems. The next morning, again at -27 deg. C I tried to use the remote starter to no avail. Several attempts resulted in the tail lights flashing once but the engine never turned over. When I tried to start the car with the key it was dead, not turning over at all or clicking. The battery was not dead and the lights and fan etc. came on normally. After three or four times turning the key it started normally. The check engine light was on, along with the brake warning light and pulsing cruise control indicator. I went straight to the dealer and the service manager said that the brake and cruise lights were linked to the check engine warning. He plugged in the computer and saw three codes which he said were random and didn't mean anything (on the screen I recall something about crank sensors...) He suggested that the problem was related to the cold weather and gave me a story about not using the remote starter when it was really cold (!) because it is hard on the battery. I assumed that maybe I had somehow flooded the car with the repeated remote starting attempts, although in retrospect the car never turned over so this isn't a logical conclusion. That evening and the next morning the car started normally with the key, still very cold weather. Friday night after work (-20 C) there was no response when I turned the key (engine didn't turn over, but the dials sweep and lights come on normally). After two tries with the same result the car started normally on the third try. No dash warnings or anything else abnormal. Last night when I tried to start the car (only -7 C this time) with the remote I got the tail light flash and nothing else. A second attempt gave the same result. Two tries with the key in the ignition and the lights came on but no response from the starter. Third or fourth try the car started and now the check engine etc. are on again. This morning (-20C) using the remote yield a tail light flash & beep but no engine turnover, then three more flashes at intervals of a few seconds then finally three beeps. With the key there is just a click like the battery is dead but the car doesn't start. I suspect that they some how fouled up the remote starter install, but have seen something elsewhere about bad software on earlier cars. I had something similar with an old VW Jetta due to a bad ignition switch but that car had almost 300,000 km on it, whereas this one is brand new with only about 250 km. I'm going to the dealer again tomorrow morning since this issue seems to be chronic and frequent, and not related only to very cold temperatures. Anybody had similar experiences or have any suggestions of what I should ask them to check? I've seen posts about a recall on these remote starters but that seems to be related to transmitter problems which cause the car to start unexpectedly, which is definitely not my case. Anyone have any suggestions or thoughts?

The dealer says the (brand new) battery seems to be bad. It has voltage but no capacity and consequently under load the voltage drops and the starter isn't engaged. Also murmurings about reprogramming the keys or a problem with the remot start module. They are keeping it overnight to try starting it cold in the morning. Conscientious response and we shall see. Not suffering in the meantime, they gave me a brand new Outback as a loaner with no hesitation.

Well, so far so good. They seem to be right and the battery was the culprit. Moral of the story I'll plan to replace with a bigger and higher capacity when this one eventually goes bad.
